Hi Experts,

A small query related to renting of commercial space.

In case a partnership firm, with four patners having equal shares, rents out its commercial property, and the rental income received is more than Rs 20,00,000/- . So, will GST of 18% will be applied in this case as total income is more than 20 Lakhs for the firm, but for the 4 partners it is less than the taxable limt of Rs 20 lakhs.

Thanks in Advance.

GST is applicable on providing taxable supply of service i.e. Renting of immovable property by a taxable person i.e. Partnership Firm, who has received the value of service which is more than the Threshold limit, in your case.

Therefore, Partnership Firm is liable to pay GST.
