Hello,

I am into Web development and providing services to clients around the globe.

If I have a client from India, I can understand GST has to be paid.

For Export, broadly, no GST is applicable. Export of services is defined as :

(6) “export of services” means the supply of any service when,––
(i) the supplier of service is located in India;
(ii) the recipient of service is located outside India;
(iii) the place of supply of service is outside India;
(iv) the payment for such service has been received by the supplier of service in convertible foreign exchange; and
(v) the supplier of service and the recipient of service are not merely establishments of a distinct person in  accordance with Explanation 1 in section 8;

Now, my question is:
Will there be any GST applicable, if I get paid through Paypal? If yes, this will be limited to % of fee charged by Paypal. Please confirm.

Hypothical example:
Invoice amount: $100 (Rs 6000)
Paypal Fee: $4 (Rs 240)
Amount deposited in bank: Rs 5400

Paypal will accept payment for us in US Dollars (USD) and will deposit to our bank in Indian Rupees(INR)

I understand the direct deposit to my account does not attract GST.

Thanks in advance.

As per my view, your client instruct to paypal to deposit the amount in your account. your client pay 100 $ to paypal and paypal deposit 96 $ in your account. that means no contractual relation ship as service provider and service receiver between you and paypal . so it is not service provided by paypal directly to you , Hanse it is not import of service and should attract the GST.
sorry should not
i am discussed about bank charges deducted by paypal

Thanks for reply

Export definition contains
(iv) the payment for such service has been received by the supplier of service in convertible foreign exchange; and

Now, paypal collects payment from our behalf in USD and then pay us in INR. My bank recieves in INR.

Please confirm, that it still doesn't attract GST.

Thanks!!

As someone sent me a PM for some details, I thought to update the current situtation here too

This is how it is working now as of today July 20, 2018:
- Paypal charges GST on the fees it applies to each payment. We can take input credit of the GST paid.
- All payments to my business are liable for GST irrespective of the fact it is export or domestic work.
- All export related GST would be refunded / adjusted. When? I don't know, there has been no refund/adjustments done till date.

Hope this helps others.
