GST number suspended and Penalty notice issued

Dear Members

One of my clients GST registration has been suspended due to non filing of returns and in March 2023 a penalty notice has been issued for Rs 25000 to be paid. I have a query that the client business is closed since 1 year and he has overlooked the GST returns filing as he was not aware of the same.

He now wants the same GST number for his new business venture. Is there some way that his penalty will be waived off if he files all the backdated returns and get the same GST number Active once again.

Quick Summary
A business owner's GST registration was suspended due to non-filing of returns, resulting in a penalty notice. The client wishes to reactivate the GST number for a new venture, despite the business being closed for a year. The advice suggests contacting the GST officer, filing all pending returns with late fees, and then applying for revocation of the GSTIN. However, there's a concern that if the suspension has been in place for over six months, revival might be difficult, though the GST officer could offer solutions if satisfied with the explanation.

First think contact Your GST officer...

2nd,
If the GSTIN can be login then file all the pending returns (note : late fee is applicable).
After that file revokation of GSTIN...

If the problem can't be short out then the PAN can't be use in GST and no way for register in GST.

Raja sir, it's over 6 months since suspension. don't think it can be revived now.

Yes dear You are exactly correct...

But, GST officer can make it simple. So only I said contact officer. If he is satisfied and accept our reply then he will give options...

Ok thanks every one.

GST suspension usually happens due to non-filing of returns or after a departmental inquiry. The first step is to file all pending GSTR-1 and GSTR-3B returns and pay the outstanding tax plus interest. Once returns are filed, you can apply for revocation of suspension on the GST portal under the user services section.
The penalty notice should be responded to separately on the portal with proof of return filing and payment. This guide covers the revocation process in detail: https://taxgarden.in/blog/gst-registration-cancellation-revocation-guide-india
