Dear Expert,

what happened if providing software services out of India, without LUT and recived payment in dollars..

In last f.y year we provide software services to foreign person out of India, for getting remittance we issued invoice without charging GST and get the money,we not show these invoices in GST return........

As per section 50 CGST Act interest is applicable @ 18%, on tax due & if not file the return then late fee is 50/- per day or Maximum 10000/- for both the act , whichever is less is applicable

IGST charged in tax invoice (without LUT) can either be adjusted from ITC available or will be paid at the time of furnishing of GST return, later on this IGST will be refund in bank account.

Dear ,
If IGST is not charged from client & No Lut is filed , has to deposit from your pocket .

I have delayed in filing renewal of LUT by 1 day fro FY 19-20 and during that 1 day I have made the exports also, what will be the consequences under GST in this case, do i have to pay IGST in this regard or can condonation for delay can be made?

Hello Neha,

Said issue already resolved by Board vide Circular No. 37/11/2018-GST dated 15th March 2018. Please refer point no.4 therein by which all such delays has been considered and condoned. Hence, no need to pay IGST or filing of any condonation for delay in filing LUT.

Sir I entered wrong year for FY 2018-19 LUT, I mistakenly filed for 2017-18 and received export of service amount for 18-19. So can I file LUT for FY 18-19 now?
