Dear Sir,

 

I have working with the PVT. organization (Manufacturing) & i have leaving this organization after completing 5 years & 2.5 months. whether i should get Gratuity  or not . if yes then how much. if no why.

you are eligible to recieve gratuity, the amout depends on your pay & organisation.

yes you are eligible for gratuity,

Your gratuity would be calculated as:

1. Your last drawn salary X 5 yrs X 15/26, or

2. Higher amount as per the employee policy of your company,

you can also claim the deduction of the same depending upon what you receive and what you have claimed in your previous gratuity (if any).

yes as per sec 4 of payment of gratuity act an employee is entitled to gratuity  if he has worked for atleast 5 years or pat excess of 6 months

you are entitle to gratuity for 15 days salary for each completed year or pat excess of 6 months and for this purpose salary should be the last month drawn salary

amt. of gratuity= last drawn salaryX15/26(excluding sundays)X5(completed yrs)

or it can be as per the syestem of your company
