I am a proprietor of a firm in Uttarakhand.

I am buying a machine from another neighbour company in Uttarakhand Y

Y will sell to me and charge 13.5 % VAT ( Y says if  I  give Form C then they will charge 3 % )

Is Form C applicable in this case ?

Is the VAT applicable as I want to export the machine I am buying from Y.

Please help as this is first time I am doing such a deal.

The benefit of Form 'C' (Lesser tax @ 3% under CST rules) can only be availed if purchases is inter-state i.e. if you buy goods from a dealer outside Uttarakhand. So, in this case VAT will be charged @ 13.5% and not the CST @ 3% because Form 'C' case is not applicable here.

VAT will be charged even if you want to export it.

If you want to Export the buying machine than You can buy this machine against Form - H. In that you his case seller of Machine can charge VAT @ 0.00 % but the condition the condition that after your export realisation you have to issue Form - H with Copy of Bill of Loading (Exported Machine's) so that Seller or Commercial Tax department can not Hassitate you or your Seller.

Both replies are correct but H Form replies is good

 

There is no Question of Form "C" as you both belongs from Same State, Yes you can purchase the goods against Form "H" with Terms as Mr Tejas Explained
