Filing of financial statements of the past 3 years by the new directors of the company

I need to file financial statements of the previous 3 years of a Pvt Ltd Co. but the financial statements have been signed by the preent directors who have been appointed in the month of September, 2015. Company was incorporated in the month of September, 2011.Then whether it would be acceptable or not.Kindly confirm me.

And I could not find 23AC, ACA and 20B at Company Forms Download page to file the previous years' financial statements, so how can I file those? kindly help me out.

Hi Jayanty,

Kindly Check the previous board minutes whether the financial statements were adopted or not.? If it was not adopted by the board during the last 3 years then the present directors can adopt the same.

Since MCA System is undergoing major changes kindly wait for old forms 23AC, 23ACA, and 20B. Do not file as an attachment to GNL-2.

Whether the company has to make application in CG-1 for condonation of delay for filing the previous years' balance sheet. And what should be attached with the form? Whether the reason for non-filing has to be mentioned in the details of application?

Iam not sure about that. If after filing 23ac aca and 20b if any remark is mentioned in challan like pending for condonation then like in the case of charge forms. Then only u need to go for condonation. Do let me know whether any condonation is required in your case.
