I want to file Form 32 of resignation in a Defaulting Company but unable to upload the same with error "The company is defaulting company and it can file this form only after filing due Balance sheets."
But as per Circular 33/2011 ROC will accept Form 32 in such companies. Can anybody please clarify why there is problem in uploading ? Is it a system error on MCA website?

No there is no error in the mca site, there can be default of non filling of Annual return in your company, so that the dsc is not being attatched in the form, if you want to file form 32 than first you should rectify your defect.
Yes, the Company is a defaulting one, but as per the MCA Gen Circular 33/2011, ROC would accept few forms of such companies including Form 32.
