As per new Rule, there is no TDS if Transporter provides his PAN. My query is if the provided PAN is fake, then who will take liability of TAX.

Deductor has to deduct full TDS and pay the transporter the balance. Otherwise his expense is getting disallowed.
HOW can a provide PAN be FAKE as per the provisions co. required to have the COPY OF PAN CARD of transporter.
Fake Pan = Invalid PAN. If transporter provides you PAN that is fake, it will not validate with te name while depositing tax. If PAN is indeed in name of transporter, it is first better to check name with Database by simulating an e tax payment as if transporter is paying tax. Copy & Paste the name that is returned and it should match the xerox that you have with you. If you get PAN does not exist or a totally different name, then it is a Fake and the deductor is responsible for deducting full tax. Therefore before paying the money, DO CHECK.
