yes. U/s 248 of the Act, under the following 4 grounds, a company is liable to get struck off by ROC:
. Company not commnced its business for a period of 1 yr from the date of its incorporation,
. Company failed to carry on it's business for last 2 yrs and has not obtained the status of dormant company in MSC-2,
. Company failed to file the declaration in INC-20A within 180 days from the date of it's incorporation,
. Company failed to intimate the situation of it's registered office within 30 days of it's situation in INC-22
But the problem is when prefilling the form STK 2 it showing an error that file commencement of business. Hence it is not possible to file form STK 2.
r u having the c.o.c of the company in INC-20A?
if yes then it needs to b attached along with the receipt of Rs.10000 as a late fee as have been prescribed u/s 10A of the Act

Can A company file MSC-2 (application for Dormant status) if it has not filed form 20A (commencement of business). It is been one year since the company was incorporated. INC20-A still not filed?

Were you able to find an answer/ solution on this?
