EXPORT GOODS THROGHT COURIER....IGST OR CGST/SGST

DEAR ALL

PLS ADVICE
WE ARE A MANUFACTUR OF COMPANY.WE EXPORT GOODS THROUTH DHL TO OUT SIDE INDIA.DHL AND WE LOCATED IN MAHARASHTRA UNDER SGT ACT BUT DHL CHARGES IGST ON EVERY SERVICES

PLEASE ADVICE WHAT TYPES OF GST LIKE. IGST OR CGST/SGST WILL BE CHARGE BY DHL?

Yes ,.. Mr Praveen you are correct .
But as per IGST Amendment Act 32, 2018 , being Notified by Notification 1/2018 ,IGST &, being effective from 1/2/19 ,

Following proviso has been Inserted in Section 12(8)(b) of IGST Act :

"Provided that where the transportation of goods is to a place outside India,
the place of supply shall be the place of destination of such goods.".

Hence even if the supplier & Recepient both are in same state , the supplier (Courier co.) is liable to Charge IGST in case of Goods being delivered out of India

But if courier company will apply IGST instead of CGST and SGST then how will exporter make claim for it. Dont you think there will be issue while filling it on Gst website.

I believe that this provisio is added to help exporters and not to hold their money.

It is very clear that as destination of goods are outside India, it is meant for export and export is zero rated under GST. DHL has to to is apply for LUT and then they dont have to apply gst. But they dont want to do that. If you

I am fighting this with DHL from past 3 months. I asked them they should either apply cgst or no gst and it they are applying IGST then they should give me in written that if my gst got struck because of wrong billing then they will reimburse me, but they are not responding. I think you should also ask them to take responsibility of their billing.

Please share your number if you facing same issue as well. It is effecting big time our business.
