There is a company who have gone out of business 10 years before . There were some loans outstanding for which the charges have been registered with ROC . After the business closure , company has settled the dues with the bank through an out of court settlement and there is an order issued by DRT to the effect that petition filed with DRT by the bank stands quashed as per the out of court settlement.  Though dues are settled , the satisfaction of charge has not been filed . Now the company wants to ffile under exit scheme .

Is it OK to file thepetition without filing satisfaction of charge ? kindly advise what is the best possible way to proceed .

As you said the Company has been closed.That means it is no more in existence.I guess no need to file for Satisfaction.
