Exemption on deduction of TDS on house rent

Dear Sir,

Can any one advise whether a house owner can claim exemption on deduction of TDS on monthly rent of Rs 22000 if he/she is non tax payer but has PAN? The property has been let out to a company.

Definitely. He/she should file ITR and claim refund if the income in not taxable.

 yes please file the returns for speedy refunds

Exemption can not be claimed on this receiving. The only way is to file return and claim the Refund.

only when assessee is not liable for tax audit

yes refund can be claimed after filing the Income Tax Return if the assessee is non tax payer

FIRST THE OWNER FILE FOR PAN OTHERWISE FROM THE AY 2010-11 IF THE OWNER DOES NOT HAVE PAN THE DEDUCTION RATE IS 20% INSTEAD OF 15%.

NO SCOPE FOR EXCAPE SO PLEASE APPLY PAN AND FILE RETURN AND PLAN HIS INVESTMENT TO GET REFUND BECAUSE TOTAL INCOME IS 264000/- .
