Excise cenvat
Please let me know whether excise duty cenvat can be taken when previous months excise duty is outstanding

Yes you can as of now there is no bar in availing Cenvat Credit in case of default of duty due to ammendment in Rule 8(3A) of Central Excise Rules

Another thing I want to ask that whether service tax return can be submitted without payment of service tax.
Yes, we can file service tax return without making payment of service tax and the service tax amoount will be shown as liability.
