Dear Sir,

supplier charge 28% GST instead of 18% we ask to many times to correct the invoice but he nothing do so can I claim 18% GST during filling 3B or note


please suggest

Better to avoid the excess ITC...

Also give request to change the tax details by the supplier. Otherwise complaint to GST Dept.
Ok pls suggest to avoid the input tax credit.

You can claim full 28% ITC if the same is being charged by the supplier and you are paying it to him even though its an incorrect rate

As said by CA Altamush Zafar...you can claim...however if he files amendment better be ready to reverse the credit

It's not good dear.

Bcoz, Even dept raise query about excess taken of ITC.

 

(Dept raise SCN to some of dealers, this is also some persons raise query in caclub)

Thanks for the clarification sir.

Department will raise query if it is in excess of Gstr2b..Since the seller is showing 28% then it will not be shown as excess. If later on seller amends the GSTR2B will itself reflect reversal/adjustments to be done in ITC..

If supplier charges 28% & if one paid full amount to the suppliers & not getting full itc as Mr. Raja Sir mentioned to not to take excess ITC ........ then customer have bearing a loss?? At that time what should have to be done by the customer ??
