Yes. As it is a Central Law.

If there is no Contray view in any other HC, then the decision of Gujarat High court is applicable to the entire Country.

Tomorrow we should be able to know the clear picture. Intersting to note here is, Gujrat Highcourt directed to collect Interest U/s 234A as well if you are filling after Sep,30th. In other words, its win win for both. The goverment will get his interest and CA's will get some breathing time... may be tax payer is loosing :-)...

We all feel relief but other side interest levy u/s 234 A is not viable due to this it result to loss for taxpayers really it is win win situation

What about statutory payments such as tds payments, 43 b covered payments, what will be the deadline for such payments
In case the date is extended the date for 43b paymens will be 30th Nov.

Is this extention applicable for Companies who are having turn over less than 1 crore ie. Non Tax Audit Companies ?

If different courts give different ruling then what will be the Impact? Instead since the decision is in favour of petitioner (Tax payer) then other petitions in different states should withdraw the petitions and let the First decision be the only decision :)
Same case to be heard by different courts and common party to all case is CBDT… Imagine the time consumed by different judiciary on the same issue… instead having all petitions to be combined and single decision… Govt says reduce the cases … if Govt really wants to reduce the cases and save some time for many people and judiciary then why no steps were taken for such issues… Hats off to CBDT for wasting so much time of everyone…

LATEST & Most Awaited News from Delhi High Court in case of Mahesh Kr & Co. Vs UOI & ors WP 5990/14 reg issue of furnishing Tax Audit Report subsequent to filing of ITR & Dt.extension.-- Petitioner's Counsel Ms Rashmi Chopra gracefully seeks permission to withdraw. Court orders "Petition Dismissed as withdrawn."CBDT's counsel urges that case has travelled so far and CBDT has granted relief by way of affidavits. However,court expresses the view that nothing remains once petition is withdrawn. However, relief already stands granted to ahssessees by Gujrat HC. As, it has directed CBDT to extend date of filing ITR to30th Nov 2014. CBDT yet to issue notification for same.
