Doubt Regarding Deductions

Dear All,
I have two basic querries regarding deductions under chapter VI - A

 (i)u/s 80G, if I have two donation receipts- one in my name and one in my wife's name, can i claim deduction on both by proving somehow that i made the payment...?

 (ii)u/s 80E, my wife paid the intrest for the year but the education loan  for my child was in my name. Can she claim deduction for the same ???

 (iii) u/s 80E, deduction is for 8 yrs from date of cahrge of first intrest or from the year in which i paid a specific intrest???

Dear Deepak,

1) This is something on which law is silent, that doesn't mean that u can claim the deduction bcos by claimimg u will be challenging the most basic evidence of the donation, but personally I feel that if u can validly prove like "the bank statement in which ur donation cheque is debited" then u will get the deduction

2) Regarding 80 E, ur case is not eligible bcos of clear language of the section - "loan taken" as well as "payment" should be by the assessee only.

3) Although keeping above facts in mind ur case is not eligible for 80 E, but anyways the period of 8 years shall be reckoned from the year in which "assesse starts paying interest on laon"

Thnx a lot for d help....but in pt 3 above suppose my wife paid int for 3 yrs and i started paying it from 4th year...for me will it be till the 12th yr or only till 8th year???

I m thinking that how our imagination can go so wild............Ha ha ha :))

Anyways, hard to say, I m only guessing that it could go upto 11 years..(from 4th year if u counts the period of 8 year comples in the 11th  year & not 12th)
