Dividend treatment in the hands of nri

Tax queries 184 views 1 replies

Hello all,

I have few doubts regarding dividend received by NRI,

  1. If the company has paid CDT u/s 115-O, dividend income is exempt u/s 10(34). Ex. During the FY 2018-19, Mr. A has received Rs. 14,00,000 as dividend income. The company has paid CDT on such dividend. what is the treatment of Rs. 14,00,000 dividend in hands of Mr. A. can he show Rs. 14,00,000 as exempt u/s 10(34)?
  2. If the company has not paid CDT u/s 115-O, such dividend is taxable u/s 115A(1)(a)(i)  @ 20%. Ex. assume in above example, co has not paid CDT on dividend paid. is the whole amount(Rs. 14,00,00) taxable u/s 115A(1)(a)(i). or is there any threshold limit above which dividend is taxable?

Thanks for help.
