If the date of submission of form 32 on resignation of directorship is after 2 months after actual resignation, can he be considered as during the interium period for legal purposes?

No, because date of resignation letter is the actual date of retirement irrespective of date of Form 32 filled.
No even if Form 32 is filed after 2 months the Director can not be held for such period because date of resignation is the date mentioned by the Director in his Resignation Letter.
