Please advise on the following:

An individual has DPIN and is already a designated partner in an LLP. Now he wishes to incorporate a Private Company in which he also proposes to be a Director.

How can he apply for DIN when the new Form DIN1 requires a declaration to the effect that "the applicant has not been allotted a Director Identification Number (DIN) under section 266B of the Companies Act,1956 or a Designated Partner Identification Number (DPIN) under section 7 of the Limited Liability Partnership Act, 2008."

What is the way out?

First of all DPIN has been abolished w.e.f.9th July, 2011.

Secondly, the person having DPIN can also have DIN number the declaration in DIN 1 is as under:-

"I HAVE NOT BEEN ALREADY ALLOTTED DIRECTOR IDENTIFICATION NUMBER UNDER SECTION 266B OF THE COMPANIES ACT, 1956."

 Hello Mr.Rakesh

I agree with Mr.Ankur. DPIN & DIN are now integrated w.e.f 09th July.

In my view no need to apply for DIN. Your existing DPIN would act as DIN.

MCA Circular No.44/2011 Dated 08.07.2011 is attached for reference. (Refer Point 4 (c))

Santosh Shah.
