Does we need to consider foreign income for salaried person

Hi

My brother is salaried person (from April 2013 to June 2013 during this time he got the salary in India) and he went to canada in july 2013 from the same company.  while preparing income tax return i think i should consider his canadian income + indian income.. but the problem is canadian company also deducted the Tax from his salary and he has also filled the income tax return for FY 13 -14 and he got some refund as well. does i need to consider his canadian income?

Last Year (FY 12-13) he has paid more than 1.5 Lakh income tax. For FY13-14 indian company has deducted 38K TDS if i consider only indian income For FY13-14 it seems whole deducted TDS is refundable. if i did not consider foreing income what will be impact or is there any chances to receive any notice from income tax on this scenario.

Could somebody please advise me on this.

Sandip

Assuming your brother was resident in India in earllier years also.

Based on the information you have provided, it can be confirmed that for tax purpose your brother is Resident and Ordinarily Resident (ROR). For ROR global income will be taxable in India.

Therefore you have to show the Canada income in India. However you can claim credit of the tax paid in Canada u/s 91 of Income Tax Act
