Income tax refund in case of death

Tax queries 557 views 2 replies

My grandmother used to get Interest income on Fixed Deposit from bank and TDS was deducted on that. (Grandma's income was less than 1,00,000). She died in January 2011. My dad filed a manual ITR to claim the refund of TDS for that year. As she had already died the bank a/c no given for the refund belonged to my dad. When the Refund Cheque came the bank refused to credit it because the cheque was named after my grandma and not my father. So, the Income Tax Advocate who filed the return wrote a letter to the Refund Issue Authority and sent the original cheque along with the death certificate. There was no communication from there side and the refund is still pending. Please suggest how to claim that refund.

Dear Friend, You are attached in GO (gegeted officer certificate),and then death certificate PAN xerox, your father bank Detail sent on IT office.

Since you have filed manual return you have to produce the following documents to the Assessing officer where u filed the return.

1. Death Certificate of your Grandmother

2. Her Legal heirship or succession certificate

3. if there are other heirs or successors other than your father then letter authorising your father to get the refund in his name. ( Some officers may insist on an indemnity bond)

4. Bank account details of your father
