Ltcg calculation: property cost of acquisition on sale

Hi All, 

I have below queries related to LTCG calculation on sale of property. Would appreciate if someone could please help me in getting the right information.

1. What is the cost of aquisition of property. In my case, there is a Sale Agreement with builder on which amount is mentioned as XX, where as there Absolute Sale Deed which is registration document with amount YY. Sale deed has lesser amount than sale agreement. If Sale deed amount is to be considered, then it means that my cost of aquisition will be lesser than actual and effectively increase my LTCG and tax liabilities.

2. Can I use the amount spent on woodwork, electrical fittings etc as part of Cost of Aquisition. I dont have any receipt of those with me now as it was 7 - 8 Years back. Is there a way or minimum amount I can show as per the rule. 

3. In case I can consider the Sale Agreement amount as flat cost, would I be able to use registrtion cost mentioned in the sale deed agreement.

You will have to consider the amolunt as per the Sale Deed only, as that is the only document that the tax authorities would consdier.  Yes regt cost will be forming part of acquisition.

for the amount spent on woodwork etc.. you can show that as Cost of Improvement incurred & claim the indexed cost of improvement from the sale consdieration.

For the woodwork and expenses, I do not have receipts. Can I still show that; Is there a procedure for the same?

Try to get the Invoices from teh Vendors.  This may be helpful, if your case is taken up for scrutiny.

I am facing a big problem with one of my client. The nature of business of my client is Trust(AOP) under income tax. On and from the assessment year 2013-14 efiling of return is mandatory as per income tax rules. I have created password for efiling of return and noted it. But unfortunately the paper has misplaced. I could not get the password for efiling return.

the system as laid down by the income tax department for reset password is as below:

1. Answer of secret question.

2. efiling acknowledgement number and Bank account number

3. Digital Signature Card

Of the above three can help to reset the password .

But my case as the paper where the password and the answer of secret question  had noted misplaced so the 1st option is not applicable here.

2nd option is also not applicable here because this is the first time my client is going to file return on line. So last efiling acknowledgement number is not available here.

3rd Option is also not applicable because Digital Signature Card is applicable for the individuals only. Inspite of that my client has done Digital Signature Card and tried to reset password. But could not be done.

Lastly as per system of Income tax regarding reset password my client has sent the details as required by the income tax department in the ID as given by the income tax department (validate @ incometaxindia.gov.in  ) as below:

1. PAN

2. NAME OF PAN HOLDER

3.DATE OF INCORPORATION

4. FATHERS'S NAME

5. COMMUNICATION ADDRESS

Income tax department replied the above mail and sent the password to the registered ID as recorded in the income tax record. But unfortunately the ID what is recorded in the income tax record to which the income tax department is sending the reset password has no existance. As a result we are not getting the reset password.

If we again request to send reset password again by giving the above data to income tax ID as mentioned above, it will come to the same ID which has no existance.

We asked to the help line but they are unable to guide me satisfactorily.

On the other hand Income tax department is not accepting the manual filing.

Now my question is how to file the return for the assessment year 2013-14 and if the Income tax department is not implementing any system then my client will never be able to file return.

What is the solution then ????
