A director in a company has withdrawed some money from the Company for business purposes.

Directors account is on the debit side of the companys balancesheet.

Will it be termed as deemed dividend?

as far as director is concern sec 2(22)(e) i.e. Deemed Dividend is not applicable as the section specifically talk about the payment of any loans or advances by company to the shareholders who have more than 10% voting powers.

for better understanding kindly refer
sec 2 (22)(e) and sec 186 of CoA 2013.
debit side is nothing but the amount advanced by the company. hence deemed dividend is applicable
