If creation of charge not intimated to ROC:-
1. within 30 days u/s 77.
2. within next 30 days 1st proviso of sec 77 AND ALSO
3. within next 60 days 2nd proviso of sec 77.
can we create a charge after 120days (30+30+60 days) as mention above ?

Yes vivek u can create it will fall under exceeding 30 days but not more than 300 days and u will have to state reason for the delay.
