Company didn't pay tax to government.

I just got an intimation from income tax department after I filed a return. There's a tax credit mismatch for a few months, as the company didn't file tax returns for Q1 2016 to government, but deducted the tax from my salary. So, I didn't pay that tax as it was already deducted from salary. As a proof, I have salary slips. I called e-filing helpline today, and they said they can't do anything about it, and I should plead before the company to file the returns. Also, Q1 2016 data is not reflected in 26AS form. Can anyone please help me. Thanks.

Salary slips are not a confirmation that TDS deducted has been deposited or not. Ask your HR Manager to issue you Form 16 or to recheck whether TDS was deposited or not against your PAN. If they have deucted and deposited TDS it may have happened that some excess credit of TDS would have been given to any other employee.

If this is the situation, ask the concerned person to revise their return, or you should seek refund of TDS amount from the employer and deposit your tax, but the Interest u/s 234 lies as per your discussion with HR.
