Commencement of business given under "other object" clause

Dear members,

A PRIVATE Company wants to undertake the business mentioned in the "OTHER OBJECT" clause of MOA.

The name of the Company is CG bricks Pvt Ltd and it wants to undertake the activities relating to the Hydro Power Plant which is mentioned in the OTHER OBJECT clause of MOA

Since Section 149 is not applicable to the Private Company, then whether it can commence the business mentioned in the OTHER OBJECT clause or members resolution is required to amend the MOA of the Company and then carry on that activity.

 

Please guide me and correct me if i am rong

Simply take a board resolution. Members approval not required.

Lal Jee, Company is not required to amend MOA, it can commence the business mentioned in the OTHER OBJECT clause. Thanks, Neha
