Certificate Course for Arbitrators

 

 

The Institute of Chartered Accountants of India is planning to launch a Certificate Course for Arbitrators. The objective of this Certificate Course is to train the members to become Arbitrators/ Consultants/Representatives in the Alternative Dispute Redressal system. The broad course contents are as follows: -

1.       The Arbitration and Conciliation Act, 1996(including Domestic and International Commercial Arbitration)

2.       UNICITRAL Model Law on Arbitration and interpretation of Statutes

3.       Jurisprudential Aspects

4.       Code of Ethics of ICAI

5.       Relevant Provisions of:

·         Indian Contract Act, 1872,

·         Indian Partnership Act, 1932,

·         Negotiable Instrument Act, 1881

·         Sales of Good Act, 1930

·         Information Technology Act, 2002

·         Intellectual Property Rights (Trademark, Patent and Copyright); and

·         Securities Contract Regulation Act, 1956

 

6.       Code of Ethics applicable to Arbitrators as per Alternative Dispute Redressal Cell, ICAI

7.       Standard Rules Applicable for Arbitrations as per Alternative Dispute Redressal Cell, ICAI

8.       Professional Duties of Arbitrators

9.       Drafting of Arbitration Award

10.   Post Award Issues

The Committee is presently preparing a Panel of Experts to act as faculty for this course across the country and for preparation of the Study Material for the course.
