If my company is buying rawmaterial from a company which is registered with Excise and I am getting the invoice deducted with cenvat. In this case if I am exporting the end product, can I get the cenvat and can I get the Duty Drawback. Will the Excise dept allow us to avail the cenvat.

Dear Sir

Please mention , is your company is 100% EOU?

dear Sir

CG has made provisions making export goods free of tax burden. Export goods have not been exempted ,they have been Zero rated.(Refer Rule 18 and 19 of Central Excise Rule, 2002).

Rule 18 is for rebate of duty

Rule 19 is for Export without payment of Duty.

Applicability of Rule 18 or 19 is based on your product.

you are entitled for the credit of duty paid on input andyou can utilise the same for the discharging your own liability of Excise.Since you exporting the goods you can take refund of the duty paid or claim duty drawback.
