Cenvat credit and sale in transit

Hello Sir,

In our Company, we have interstate sale with in "Sale in transit mode", We have a situation as mentioned below.

Our Vendor is in Madhya Pradesh and my customer is in Andhra, We have asked the vendor to despatch the goods directly to our customer, by taking E1 form, but what about CENVAT Credit? 

01. Will my vendor charge me Excise Invoice? How to take credit on Cenvat

02. If we are not eligible for Cenvat credit, to whom the customer will pay the Excise duty?

Kindly clarify me...

We have atleast 4-5 similar cases every month.

Kindly suggest us.

Their is a simple invoice is made by your is in that he mention Your name as customer and your customer name as consignee in that case your customer can take credit of excise duty
