Case laws in icwai inter exam

Hi all,

I am peparing for ICWAI Inter exam.In Direct Taxes paper, I wanted to know following on using case laws in Direct Taxation paper-

1.How often to use Case Laws. Do the papers contain specific questions relating to case laws or do we give reference to case laws while giving answers to questions.

2.How necessary is to write case law. Will there be any negative marking if answers are not supported by case laws.

I am facing difficulty in remembering the Sections and particularly citations of case laws. Can you please help in answering the above mentioned queries.

             There is no doubt about it that, a case law in a given answer  will enhance the quality of your capability and also carry a good marks  but if you 100% sure, then you mention case law for an answer  otherwise not,  because   

i)  If In the given answer , case law as well as section is correct, then ---> Full credit will be  given.

ii) If  in the given answer, case law as well as section is incorrect, but theory portion is correct, then ----> Definitely No credit will be given.

iii) If in the given answer, there is no mention of case law as well as section and if theory portion of answer  is correct, then in that case ------> at least 50%-60% credit will be given.

 So, if you 100% sure , then you can otherwise definitely not.

  One thing you must remember, that

                 " Action without motivation is powerless

                                                   &

                    Motivation without action is baseless".
