Capital gain - possession or date of agreement

Dear All,

I had booked flat in Mumbai around 2007 which was under construction and registered the same in 2007. Its construction completed in 2011. I had physically taken the possession and occupied flat with consent of builder in 2011, but due to some deficiency in service by builder towards local authority he had not issued possesion letter to me.

Pls. let me know the taxation point of Long Term Capital Gain. Whether date of registration or date on which I had taken physical possession without possession letter from builder or the future date when builder will issue me possession date. I have some documents with me such as gas connection, MTNL bill, Passport and Ration Card which shows that I am residing this place since last two years.

Date of regn.. the date when the deed was written.. The physical date of possesion is not relevant in ur case based on input given..
Or the deed shud provide the date of completion n ready fr occupancy.. Accordingly it shud be determined...
