Can mother get deductions against sons Loan, Premium u/s 80E, 80D,

Tax queries 2078 views 6 replies

Q, on section 80E of Income tax

Whether One (she) can claim deduction on interest against Edu.Loan U/s 80E, if that loan is on the name her son (is working/earning) with co-borrower’s name as her spouse, not her name. Can she prove to i-tax that the named borrower is her son by other than the proof as co-borrower. Loan EMI are being paid through her bank A/c as 2nd A/C holder along with her spouse.

Will this be acceptable by i-tax if notice is issued? Is this accepted by I-Tax rule to get tax deduction?

Q on i-TAX section 80D :

Health/medical normal single policy has been taken on the name of son-who is earning, with parents name as his mother and father name as being member of the policy.

Can the mother claim the tax deduction ?

Can any expert please guide me, on the high time of ITR, as immediately as possible, I will be thankful?

Answers for both your questions is

No.

Any deductions can be claimed only by the Individual:-

who has taken the loan,

has got the Insurance policy in his/her name.

Hi Ranjan,

I differ from you as most of portals says can be claimed by other than Loan & health policy holders but with certian conditions/ limitations Whether "she/I" can with in That limitations , has to be clarrified

In 80D , my children is primary health policy holder but earning

for 80E, I-tax portal says just loan for "relatives" can be. My son falls under the relatives, but I am not mentioned in th loan doc. as co-borrower, so can't she claim in other  wards can she not claim the relation by other than that "co borrower" as ptoof?  Pls Ref: incometaxindia.gov.in

Can I expect some more people clarify me

@ Baskaran

I again went through the I-T portal about the 80D and 80E deductions.

And found your interpretation is not valid.

In both cases, i.e. The policy holder, and the Education loan Borrower should be the person claiming the deductions.

Since you do not agree with my interpretation, you can wait for someone more expert to answer you.

Best of luck

@ Baskaran

One more thing.

Now, for any deduction claim, full details have to be furnished in the ITR, of the Policy, Bank details etc etc for loan, so that no invalid claims get accepted.

And it applies even for the simplest, ITR-1

Ok sir,

Waiting for any body to give better / favourable  / pracical solution.

I shall give in e-portal for  bank-loan and health policy Number.  Only the thing is claimant is parent with the limitations explained. Do the I-TAX dept verify the details with the bank & health insurance co.?

@ Baskaran

I have not tried, because I did not need these deductions.

You can try it out.

CPC is using AI for fast data comparison from various sources.

So results would depends on what data is available to the CPC AI.
