Ca partnership deed query-please help

partnership has not been validly formed. Notary of partnership deed is not mandatory (unless u go for registration of firms under partnership act 1932). But appropriate amount of stamp duty has to be paid depending upon the capital of the firm.
There is no time limit for preparation of partnership deed. It has to be prepared on valid stamp paper/franking at the time of formation.
it should be effective from the date on which stamp duty is paid. It cannot be dated retrospectively.
This is my view. waiting for the view of other experts.
