C Form on Gross or Net

Dear Members,

Kindly clarify a querry.

 
The Sales Tax Officer is of view that "C" form has to be received on Total Sales Value (i.e. net + tax amount), but our client has received a "C" form which is of Net Amount, is there any circular/ notification or some clarification that "C" form can be issued on Net Value.
 
Kindly sort out the same as soon as possible.

It is on the gross amount of the bill and not net amount this is clearly evident
HI Vijay it is only on the gross [net + gross ] value not on net value well now the point is how to solve this for that MAY BE [VIEW] Client can ask for dupicate C Form but there is no provision i think
it is issue on net amount.
dear vijay, the c-form issued by the customer for net amount is acceptable to vat department. in the past, we have reced. c-form in that manner & have been accepted. you can contact your cs for notification. regards ajay
C form Covers the value os sale turnover bought under CST. It has to be on gross value
Can any one provide me details about any circular issued to effect that purchasing dealer should mention the amount inclusive of CST in C Forms? If there is any circular in this regard, that must be binding and there is no scope of argument. Otherwise, I donโ€™t think that there should be any problem if the purchasing dealer is mentioning sales price (excluding CST) in the C form. Reason of my such opinion is that- the requirement of the act is that the said C form should only confirm the sale transactions. On the presumption that as the concessional tax of rate is available only on the sale price (net of CST), if some one is showing such values only in his C forms, I donโ€™t think that there should be any problem. โ€œCโ€ form is issued to certify the particular transaction of sales only. Now, coming to the issue that such C form will not be accepted by the department, what will be the options with the department? Can they reject the C form and tax the whole sales at a higher rate? Can they say that the amount of difference, which is the amount of CST is a local sale?
