Banquet gst credit

Hi,

We do exhibtions, where we sell and charge for a package in which we sell stall space, rooms and food in same hotel.

Can someone help doing above can we claim ITC on food given in banquets ? There is a quite a confusion, if someone can give exper opinion.

Yes you can claim ITC
Yes the food provided in Banquets the ITC can be claim by Supplier (Its being block for Resuratant)
Pankaj ji but even restaurant is engaged in outward supply of food the should restaurant be also eligible for claiming ITC?

No , as per Notification 46/2017 CT (r) , the resturant is liable to charge GST @ 5% without ITC , only resturant in hotel (5star) where room terif is more then 7500/- can charge @ 18% gst under forward charge & can avail ITC
But am not in business of food, the hotel is, will I act as supplier this case ?
Ok kkk fine ... you are selling your package by organising exibition/meeting at hotel & book the Banquet to provide food to your customer .

For Food bill ITC is block U/s 17(5)
For Banquet Rent you can claim ITC
ITC is Blocked u/s 17(5) of CGST Act 2017 for fooding expenses...
