Quick Summary
This discussion addresses a common GST query regarding the Input Tax Credit (ITC) for bills that were not uploaded by a supplier in the correct month. The user's supplier uploaded December 2020 bills in March 2021, and the user wants to know if they can claim the ITC in their December 2020 GSTR-3B. The advice given is that generally, you cannot claim ITC for December 2020 in your March 2021 GSTR-3B due to Rule 36(4) restrictions. However, if the ITC amount is within a certain percentage (5% or 10%) of the total ITC available for December, it might be permissible to include it in the December return. Otherwise, the ITC should be claimed in the March 2021 GSTR-3B.

If you are now planning to file GSTR3B for Dec20 and want to include the missing bill in Dec20, check whether such ITC is less than 5% (or 10%) of total ITC available for Dec20. If within the limit, you may include in Dec20 return, else add this bill in March20 return.
No as per rule 36(4) restricted you to take the itc benefit in Dec . you can take the Itc in March Gstr 3b only
