At ability of receipt of advance paid to a builder for an apartment

NRI has paid advance for vying an apartment to a builder. Now due to pandemic situation, the NRI decides cancel the deal. The builder has agreed to pay back the money. What is the tax liability in the hands of NRI if it is received ion an NRO account in India
