Our Whole Time Director(WTD) Appointment ends on Oct 20th, but our Board meeting is going to be held on Nov 8 th .Can we appoint WTD retrospectively from Oct 21st by the Board of Directors ? friends reply me its very urgent.....

According to me re-appointment of WTD with retrospective effect is possible due to non-applicability of section 317 on WTD but it is not advisable.
However retrospective re-appointment of Managing Director is not possible due to section 317.
If possible pass a BR in back date for re-appointment.
