Yes, Such a person can be appointed as the Mnaging Director of the other Company because as per section 2(54), managing director is the director who by virtue of the articles of the Company or by ordinary resolution passed by the Company is entrusted with the substantial power of the management which means day to day administrative powers of the mangement of the Company , th
Trust the same holds true for his appointment as a manager in other co. ?
Refer Section 203(3).
Sec 203 (3 ) gives 3 exceptions . These exceptions nowhere cover Managing Director or a Manager who is already appointed as a whole time director in a company. As there is no restriction , so i believe that we can appoint a person as a manager or a M.D of another company , who is already a WTD in our company .
