Applicability of service tax for freight reimbursement

Request clarification on Service Tax payment in the case of Freight charges reimbursed to the Supplier who has engaged the truck/lorry and sent the material. Where the supplier raises a Debit note to the consignee claiming the freight amount.

Is it the Supplier or the end Consignee; who is liable for Service tax?

You are not liable to pay service tax.

not liable to pay tax , but the supplier will debit the full amount of frieght  with service tax ... right

Dear Dayananda & Selvan, Thank you for the replies.

But the Supplier is not debiting the full amount. He is raising debit note only for freight amount which is not inclusive of Service tax on it.

Even I am in argument with my senior that sevice tax is not applicable.

But still ambigious..

 

service tax is can not be avoided, if the supplier has discharged the duty of ST then you are not liable, provided he produce the documents of payment , but if he has not, then take initiative and pay the same by own.
