if a person is engaged in the Business of transportation of goods on casual basis that is on order basis and he is in the possession of 3 trucks, can he file presumptive income u/s 44AE.

Yes. You can opt for presumptive income under 44AE.

section 44AE is available to person who has upto 10 vehicles during the year.

so in your case the assessee can opt for benefit of section 44AE
