Anonymous donation

If we received donation in a charitable organisation and maintain Name and address of the donor but not PAN of the donor.

Whether in the absence of PAN donation'll we treated as anonymous donation or record of name and address is enough to

fulfill the compliance of Income Tax ACt.

PAN is not necessary.

The Act says name and address of the donor AND SUCH OTHER PARTICULARS AS MAY BE PRESCRIBED.

 

Pan is compulsory.......... Such other particulars means pan no, sign and stamp value if exceed 5000.

Dear, Hemang please tell me relevant section or rule no. 

clause (3) Section 115BBC states the following:

(3) For the purposes of this section, “anonymous donation” means any voluntary contribution referred to in sub-clause (iia) of clause (24) of section 2, where a person receiving such contribution does not maintain a record of the identity indicating the name and address of the person making such contribution and such other particulars as may be prescribed.]

The words 'such Other particulars as may be prescribed' as stated in the section, would also mean that there is an requriement of PAN.  Hence if PAN is not available then it would be treated as an anonymous donation.

"particulars as may be prescribed' is not clear. There is no Rule as yet presribed in this connection to keep the particulars in addtion to name aqnd address. -r.d.daga
