Regarding the Maharashtra VAT Amnesty Scheme 2023, here’s a summary relevant to your query:

Key Points on Maharashtra VAT Amnesty Scheme 2023:

  • The scheme allows for write-off or waiver of penalty and interest on outstanding VAT dues under certain conditions.

  • Amount threshold: Debts below Rs. 2 lakh can be written off fully, subject to scheme conditions.

  • However, for dues to be eligible for write-off, there must be an assessment order or demand order issued by the department.

  • If there is no statutory order (no demand or assessment order) from the department, and no appeal filed, the liability remains as self-assessed.

  • In such cases, amnesty scheme benefits like write-off may not apply fully.

  • Typically, the scheme requires a certain percentage payment (often 15%) to be made on such outstanding dues to avail the waiver on the balance.

  • So, if no demand order exists, the interest payable might not be eligible for complete write-off without payment.

What this means for your case:

  • Since you have interest payable of Rs. 1,20,000 for FY 2012-13 without any demand or appeal, the amount might not be directly written off under the scheme.

  • You may need to pay 15% of the amount (i.e., Rs. 18,000 approx) to avail the waiver on the rest.

  • Please verify the exact provisions of the Maharashtra VAT Amnesty Scheme 2023 notification.

Suggestion:

  • Consult the official Maharashtra VAT Amnesty Scheme 2023 notification for exact eligibility and payment terms.

  • Contact your local VAT department or a tax consultant for confirmation before proceeding.
