Sir, A Construction company newly formed without following Part IX rules as they were holding existing partnership firm. Now they are facing some difficulties with enlistment auth. to get enlistment/tender as the newly formed company credentials NIL and EXISTING FIRM details not mentioned in the starting of MoA, they are rejecting MoA.
Now can they proceed form take over or other procedure and Can they add some BACKGROUND NOTE of existing firm before main objects by ALTERATION of MoA. Please help us
