1996 views 3 replies

Dear Sir/ Mam,

The  client company's due date was 30/9/2012 for holding AGM which has elapsed. For this, it has not pre intimated ROC. Therefore, it has commited an offence under Sec 166.

Now pls tell me the next proceedings...?

How to apply for compounding of offences incase of non closure of books of accounts to CLB?

Pls reply...

Thanks in advance.

Regards,

Yash Mehta

First of all file all the required forms like 20B, 23AC &ACA , 66 then u can ask for voluntary compounding.

Secondly if u hv not place the accounts in the AGM then the violation of related sections can also be raised...

Thanks for the reply.

But in this case, AGM has not been held yet..!

So whether compounding of offence procedure under 621 A is applicable oe what?

Hold the AGM now and file all documents (annual return, Balance Sheet, etc. etc.) and then file application for compounding of offence u/s 621A.
