Additional duty (Imports) under 19/2006 -Cenvat Credit doubt

Dear Sir(s), 

Kindly clarify me that when we are Importing goods from other countries,

normally we are taking Cenvat Credit 10.3% of CVD under Excise,

my doubt is ,

additional duty  4% (imports) under 19/2006 notification is eligible to take as cenvat credit under central excise or it to be taken under VAT as VAT Credit. (pl.not that we have paid entire customs amounts CASH only)

you can use 4% additional duty (Import) as cenvat credit, 

not as a vat credit

If you are having enough credit, you can get refund of this ADC provided you prove that you are paying VAT on your final product and correlating the inputs and outputs.

can we used the addtioanl duty (4%) for payment of service tax, if yes what is the % of availnment.

 

Dear Sir,

I have recently joined this company, & they have not taken cenvat credit on additional duty of 4% earlier, I know additional duty of 4% on imports is eligible for cenvat credit, Is it possible now to utilize the AD on imports for the year 2015-16?
