A Temple is registered under The Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987.

Does temple be treated as Trust or Artifial juridical persons or Association of Persons.

if I want to apply for exemption under section 80c IT act, what is procedure for it.

if it is trust, do i require to register once again with sub register as trust since we donot have any trust deed.

I am under impression that I need not to go for registration of trust since Temple is already got the certificate under The Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987. so that it is treated as trust, I can apply for exemption with certificate received from Endowment department..

Dear Prakash,

Let me first clarify you the applicable Section. The exemption available to the Donees is u/s 80G not u/s 80C.

To get an exemption under 80G, you have to first obtain 12A. You can apply for both 12A and 80G simultaneously. Now, 80G is for lifetime of the trust.

Hence, apply to the concerned IT authorities with the Trust deed and get 12A and 80G.
