194h of tds on brokerage paid member of stock exchange

Want to Kown if Section 194H is applicable on Brokerage paid to Sub-broker, being a member of Stock Exchange. 

Pls provide case law in this favour.

I am aware its not applicable, but need a case law to support the statement.
