Zomato Faces Fresh GST Demand and Penalty Order Over Rs 2 Crore

Zomato, the renowned online food delivery aggregator, finds itself amidst yet another tax-related hurdle. The Goods and Services Tax (GST) authorities have issued a fresh demand and penalty order against the company, amounting to a staggering Rs 2,22,91,376 in GST demand. This sum is further compounded by interest charges totaling Rs 2,08,98,164 and a penalty of Rs 22,29,136, covering the period from July 2017 to March 2021.

Zomato, however, is not taking this development lying down. The foodtech giant has announced its intention to contest the order, expressing confidence in the strength of its case. In regulatory filings, Zomato stated, "We believe that we have a strong case on merits and the company will be filing an appeal against the order before the appropriate authority."

This recent setback is not the first of its kind for Zomato. In the preceding month, the company was served with another GST demand and penalty order, this time amounting to a staggering Rs 11.81 crore. Additionally, Zomato received demand notices for short payment of GST, totaling Rs 4.2 crore.

The cumulative effect of these tax-related challenges is significant. Zomato, a public-listed entity, had already been grappling with a substantial GST demand of Rs 5,90,94,889, inclusive of interest and penalty charges. This demand stemmed from earlier notices amounting to Rs 23 crore and Rs 92 crore, underscoring the complexity and scale of the tax dispute.

The specific focus of the latest order revolves around export services rendered by Zomato to subsidiaries outside India. The order, issued by the Additional Commissioner of Central Goods and Services Tax, Gurugram, underscores the intricacies involved in tax compliance within the digital economy landscape.

As Zomato gears up to file its appeal and navigate through the intricacies of tax regulations, the outcome of these proceedings remains uncertain. Nevertheless, this development sheds light on the challenges faced by digital platforms operating in a dynamic regulatory environment, underscoring the importance of robust compliance mechanisms and legal strategies in safeguarding their interests.
